Bondi Babe Rewards Loyalty Terms And Conditions

 

1. The Bondi Babe Rewards Loyalty Program (“BBR Loyalty Program”) is offered by Bondi Sands Pty Ltd ABN 98 613 297 813 (‘Bondi Sands’, ‘we’, or ‘us’).

2. These terms and conditions apply to the BBR Loyalty Program and any promotional activity and member transactions relating to the BBR Loyalty Program. By registering for and participating in the BBR Loyalty Program, you agree to be bound by these terms and conditions.

Sign Up to the BBR Loyalty Program

3. You can sign up to the BBR Loyalty Program online at the following website: https://bondisands.com.au/pages/rewards, https://bondisands.com/pages/rewards, https://bondisands.co.uk/pages/rewards, https://bondisands.eu/pages/rewards, or any other sign-up method authorized by Bondi Sands. You will be automatically enrolled in the BBR Loyalty Program when you make a purchase online.

4. You must notify us if your email address or any other personal details provided as part of sign-up changes. Bondi Sands is not responsible for any loss of BBR Loyalty Program benefits arising from you not notifying us of any change in personal details.

5. Limit one (1) Bondi Babe loyalty account (“Account”) permitted per person and per email address.

6. Bondi Sands staff are not eligible to join the BBR Loyalty Program.

7. Bondi Babe Rewards Points balance and rewards are not transferrable and cannot be shared with anyone else.

8. You must be at least 16 years of age. If you are under the age of 18, you need the consent of your parent or guardian to join.

9. The BBR Loyalty Program is available to Bondi Sands customers in Australia, New Zealand, United States, United Kingdom, Ireland, Netherlands, Germany, Norway, Sweden, and Denmark, and to customers that reside in countries where the following brand sites ship to and when purchases are made through the following websites: bondisands.com.au, www.bondisands.com, www.bondisands.co.uk, www.bondisands.eu. Among other countries and without limitation, the BBR Loyalty Program is not available in Canada. Please see Annexure B for a complete list of restricted countries.

Member communications and personal data

10. When you join the BBR Loyalty Program, you agree to receive email communications from Bondi Sands for the purposes of:

    1. providing you with marketing, product and special offer information; and

    2. notifying you of matters relevant to your Bondi Babe loyalty membership, including Points and rewards expiry.

You can opt out of receiving these emails by clicking the ‘unsubscribe’ button at the bottom of any Bondi Babe’s email or updating your preferences.

11. By joining the BBR Loyalty Program you agree to let us collect, use and disclose your data (including personal information) in accordance with our Privacy Policy and these terms and conditions.

Earning Bondi Babe Rewards Points

12. You can earn Bondi Babe Rewards Points (“Points”) by making a purchase, sharing on social, leaving a review and/or referring friends. Current options and further details on each option for obtaining Points are listed below:

    1. Purchases:Earn one (1) Point for every dollar (rounded down to the nearest dollar) you spend on Bondi Sands products, both online at https://bondisands.com.au/ and in store, via an Authorised Reseller (see Annexure A for full list), as per below. Spend excludes shipping costs and Points are calculated on your actual spend after any discounts, gift vouchers/gift cards:

       1. Online Purchases: Simply shop on our online store (https://bondisands.com.au) and your Points will be automatically added to your Account once the order is shipped. You must be signed into your Account when you make a purchase for Points to be accrued;

       2. In-Store Purchases: Take a photo of your receipt for your Bondi Sands purchase via an Authorised Reseller and upload your photo to your Account at https://bondisands.com.au using the receipt upload section. You must be signed into your Account for Points to be accrued.

Points will be accrued at the following rate:

1 point = $1 AUD spend (Australia)

1 point = $1 USD spend (United States)

1 point = £1 spend (United Kingdom)

1 point = €1 spend (Europe)

b. Share: From time to time, Bondi Sands may offer an opportunity for BBR Loyalty Program Members (“Members”) to earn extra Points. Earn an extra twenty (20) Points when you share the BBR Loyalty Program on your Facebook as per instructions provided in any advertisement for a 20-Points bonus offer. The Points will be awarded when someone clicks on the post on Facebook, not when you share the post. From time to time, Bondi Sands may reward our fave Bondi pics on Instagram with bonus Points. To be eligible, be sure to tag @bondisands and include #bondibaberewards for a chance to get some extra goodies! If your pic is selected, our Bondi Team will DM you your loyalty Points or Voucher.

c. Following: Earn ten (10) Bondi Babe Rewards points when you follow Bondi Sands on Facebook; Earn ten (10) Bondi Babe Rewards points when you follow Bondi Sands on Instagram; and Earn ten (10) Bondi Babe Rewards points when you follow Bondi Sands on TikTok. In order receive the Bondi Babe Rewards points you must click through to Facebook, Instagram and/or TikTok from the Bondi Sands Rewards webpage;

d. Review: Earn one hundred (100) Points when you leave a review at https://bondisands.com.au. Must be signed into your Account before placing the review and your review must include #bondibaberewards. For a photo or video attached to your review we add an extra fifty (50) Points. Reviews that contain obscene, offensive, or other language and/or images communicating messages inconsistent with the positive images with which Bondi Sands wishes to associate itself (as determined by Bondi Sands in its sole discretion) will be void and disqualified. Each review should reflect the your honest and truthful opinions and actual experiences. You should be sure to have used the products, and done so consistent with stated instructions. Maximum of two (2) reviews per person, per customer, per month.

e. Refer: Earn two hundred (200) Points when you refer your friends by using our referral section of our website to invite your friends to join Bondi Babe Rewards. Your friend must join before you will earn the 200 Points. There are no restrictions on the number of friends you may invite. Each referral must be manually key stroked and manually entered by the individual member. Automated and/or repetitive submission of referrals (including but not limited to referrals made using any script, macro, bot or sweepstakes service) will be disqualified. Automated or bulk referrals made by third parties will be disqualified.

Please only refer friends who are happy to receive information from Bondi Sands and who have given their consent for you to pass on their details.

 

13. Examples of the award of Points for purchases where a discount/gift voucher applies, are outlined below:

    1. If you purchase a product which is $100 and receive a 30% discount on the purchase (total spend $70), you will receive seventy (70) Points.

    2. If you purchase a product which is $100 and use a $40 gift voucher on the purchase (total spend $60), you will receive sixty (60) Points.

14. For in-store purchases, points may take up to 24 hours to be credited to your Bondi Babe Rewards account after completion of the upload of your receipt to the Bondi Sands website. For online purchases, Points for order made on the Bondi Sands website will be awarded once the order is marked as ‘paid’ in Shopify.

15. We may deduct from your Account any Points:

1. credited to your Account as a result of an error;

2. relating to a transaction that has been cancelled, reversed or refunded;

3. relating to any suspected fraudulent activity; or

4. relating to an order that Bondi Sands reasonably believes was for a commercial purpose or commercial in quantity.

16. Your Bondi Babe Rewards Point balance and any Vouchers you redeem through the BBR Loyalty Program are not transferable to anyone else and are not redeemable for cash.

Redeeming Bondi Babe Rewards Points

17. You can redeem your Points for Vouchers or products available in the Bondi Babe Rewards current product catalogue. Bondi Babe Rewards Vouchers (“Vouchers”) are redeemable at bondisands.com.au. Only one Voucher can be used per transaction. Vouchers can be self-issued via www.bondisands.com.au by following the prompts to redeem Points for a Voucher on site. Once Points have been redeemed for a Voucher, you cannot then redeem the same Points for a product, and vice-versa. We have a range of products available in our product catalogue for you to also purchase with Points. Have a look at our top picks you can redeem within your logged in Account online at www.bondisands.com.au. Once you choose to redeem your Points for a product, you will be issued with a product code (“Product Code”). You must select that product at www.bondisands.com.au and include the Product Code at checkout to redeem. Standing shipping fees will still apply.

18. You won’t be able to use your Voucher or Product Codes at checkout if we have a site wide promotion in place. Site wide promotions include discounts applied at checkout, two for one promotions, and discounts on shipping fees. However, any other time you will be able to use your Voucher and Product Codes.

19. When you convert your Points into a Voucher, you will have 60 calendar days from the date of conversion to use your Voucher. If you return or cancel an order in which you redeemed a Voucher, the Voucher will be reissued to your Account with its original expiry date.

20. Each Voucher can only be used once and Bondi Sands will not be held liable if a Voucher is not able to be redeemed for any reason. When using a Voucher, you must spend at least $1. Vouchers are not valid for use towards the purchase of gift cards. Bondi Sands reserves the right to exclude certain items and promotions from being redeemed by using a Voucher.

21. Points will expire 12 months after they are earned. This means that if you make multiple purchases in one year, you will have Points expiring on multiple dates the following year. If you are to return your order after Points were assigned, those Points will be deducted from your Points balance. For example: If you spend $50 on 1 March of the first year, you will earn 50 Points. These Points will expire at the end of February of the second year.

22. We will notify you using the email address linked to your Account approximately one (1) month before any of your Points are due to expire, if you have not opted out of receiving loyalty communications.

24. Your Bondi Babe Membership year starts from (i) the date you joined Bondi Rewards; or (ii) the date you last changed or maintained your Membership Tier (whichever date is later). Your Bondi Babe Membership year runs for 12 months. (a “Membership Year”).

25. You can accumulate Bondi Babe Membership Tier spend by making a purchase:

    1. Online Purchases: Simply shop on our online store (https://bondisands.com.au) and your Membership Tier spend will be automatically added to your Account once the order is shipped. Must be signed into your Account for Membership Tier spend to be accrued;

    2. In-Store Purchases: Take a photo of your receipt for your Bondi Sands purchase via an Authorised Reseller (see Annexure A for list) and upload your photo to your Account at https://bondisands.com.au using the receipt upload section.

26. Spend excludes shipping costs and Points are calculated on your actual spend after any discounts, gift vouchers/gift cards.

27. For online purchases, Membership Tier spend will be credited to your Account once your order ships. For in-store purchases, Membership Tier spend may take up to 24 hours to be credited to your Account.

28. At the end of each Membership Year, your Membership Tier will be determined by your spend on Bondi Sands in that Membership Year and your spend balance will be reset to $0. You will then remain in that Membership Tier until the end of your next Membership Year, unless your rolling 12 month spend qualifies you to move to a higher Membership Tier, or if your Points balance is less than the minimum required for that Membership Tier, you will downgrade to the previous Membership Tier.

29. We may deduct from your Bondi Babes Membership Tier spend balance any amounts:

• credited to your Account as a result of an error;

• relating to a transaction that has been cancelled, reversed or refunded;

• relating to any suspected fraudulent activity; or

• relating to an order that Bondi Sands reasonably believes was for a commercial purpose or commercial in quantity.

 

30. The benefits that members of each Membership Tier are eligible to receive are set out in the table below. These benefits may change, but if we reduce the benefits that apply to the Membership Tier you are in, we will let you know by sending an email to the email address linked to your Account, if you have not opted out of loyalty communications

31. Your Bondi Babe Rewards Membership may be terminated or suspended if we reasonably suspect that you have:

    1. breached these terms and conditions;

    2. engaged in or may engage in fraudulent conduct, or conduct that is reasonably suspected to be fraudulent, in relation to your Bondi Babe Rewards Account; or

    3. engaged in inappropriate conduct that undermines the legitimate interests of Bondi Sands.

 

Receipts

 

32. Receipts submitted to claim Bondi Rewards Points and for Bondi Babe Levels will be verified by the Bondi Sands’ moderator and will not be accepted until the verification process is complete. Bondi Sands reserves the right to retrospectively invalidate any points or membership gains awarded if it later determines a receipt submitted to be invalid, tampered with and/or otherwise not submitted correctly in accordance with these terms. Any receipts uploaded must be clearly legible and compliant with the requirements outlined below. The Bondi Sands moderator reserves the right to disqualify any receipts it reasonably suspects to be submitted fraudulently, is not a valid receipt or is not clearly legible, whether it does or does not strictly meet any of the following requirements.

    1. Brand’s products are visibly shown in receipts verified with SKU 

    2. Store Logo / Branding clarity

    3. Numbers and fonts in the receipts appears consistent

    4. Numbers in the invoice are not overly repetitive (Benford’s Law)

    5. Receipts appeared freshly printed and not crumpled or stained

    6. Quality of scanned and captured receipts

    7. Item pricing and receipt amount adds up perfectly

    8. Date of purchase does is not older than 6 months from upload

Bondi Babes Birthday Rewards

33. Members who are eligible for a Birthday reward will receive their Birthday gift via email (if they have not opted out of loyalty communications) on the birthday noted in their account, or at such other time as Bondi Sands considers appropriate. Birthday Rewards may change from time to time at Bondi Sand’s discretion. The 50 bonus points for your birthday will be provided on the date of your birthday.

34. Your Birthday gift is redeemable online only and must be used within 30 days of the date of issuance. You must be logged in to your Bondi Babes Rewards account to redeem your Birthday gift. Birthday gifts that are not redeemed within 30 days of issuance will be rendered null and void.

General

35. Bondi Sands reserves the right to moderate and remove points from customers/purchases if Bondi Sands expects illegitimate activity (ie. Buying bulk products in a retailer and then returning these after points have been allocated).

36. You may terminate your Bondi Babe Rewards membership at any time by contacting Bondi Sands customer service.

37. If your Bondi Babe Rewards membership is terminated (by you or us), all outstanding Points and any Bondi Babe Rewards Vouchers you have redeemed will no longer be valid and will be rendered null and void.

38. We may cancel or suspend the BBR Loyalty Program or change these terms and conditions at any time. If we do, we may or may not notify you, depending on the change we make. An up-to-date copy of our terms can be found at https://bondisands.com.au/pages/bondi-babe-rewards-terms-conditions

39. Where Bondi Sands gives you notice by email, you agree that the notice is deemed to have been provided to you on the date of the email.

40. These terms and conditions do not limit your rights under the Australian Consumer Law. If you are a consumer under the Australian Consumer Law, our goods come with guarantees that cannot be excluded under law.

41. These terms and conditions are governed by the laws of the State of Victoria, Australia.

42. You must comply with all applicable laws, codes and regulations including any advertising codes requiring that you disclose when a post or review is incentivised and that the post is prominently labelled with #AD in a place which is obvious to viewers.

43. You agree to:(a) not make any false statement relating to Bondi Sands in public or online (including on social media), to the press or elsewhere;

(b) remove any violative or improper posts over which you have control at the request of Bondi Sands as soon as practicably possible.

44. For United States residents, except where prohibited by law, as a condition of participating in the BBR Loyalty Program, each Member agrees that (1) any and all disputes and causes of action arising out of or connected with this BBR Loyalty Program shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of JAMS and held at the JAMS regional office nearest the Member; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will any Member be permitted to obtain awards for, and Member hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Member’s actual out-of-pocket expenses, and Member further waives all rights to have damages multiplied or increased. Members further agree that any and all disputes, claims and causes of action arising out of or connected with this BBR Loyalty Program shall be resolved individually, without resort to any form of class action. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions, or the rights and obligations of the Member and Bondi Sands in connection with the BBR Loyalty Program, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

45. Bondi Sands’ decisions with respect to all aspects of the BBR Loyalty Program are final and binding on all Member’s without right of appeal. Any attempt by any Member to obtain more than the stated number of Points by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Member’s Points. Use of any automated system or service to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the Member. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Any automated computer receipt or statement of account does not constitute proof of actual number of Points. Bondi Sands reserves the right to withdraw, amend or suspend the BBR Loyalty Program (or to amend these Terms & Conditions) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond its reasonable control. Any attempt to deliberately damage or to undermine the legitimate operation of the BBR Loyalty Program in any way is a violation of criminal and civil laws and should such an attempt be made, and Bondi Sands reserves the right to seek remedies and damages to the fullest extent permitted by law.

You understand and agree by participating in the BBR Loyalty Program that we can make these changes at any time, with or without notice. However, we may give you notice of changes to the BBR Loyalty Program by posting an updated version of this page at www.bondisands.com.au/pages/rewards or via email. Bondi Sands reserves the right to terminate the BBR Loyalty Program with six months' notice, without compensation. This means that regardless of the number of Points you accumulate in the BBR Loyalty Program, your right to accumulate and redeem Points can be terminated six months after we give you notice.
